1. General Rules

Salacca is selling only to natural or legal bodies which are legally entitled to do business. Customers are asked to provide true and complete data which is necessary for an order, such as name, address, etc.

2. Area of Validity

The general terms of business as outlined here are valid at the time of internet or direct order and are exclusively relevant for salacca´s business with its customers.

3. Prices

All prices indicated in the e-shop are EUROs and final prices include VAT, presently at 19% on non-food and 7% on food items respectively. Prices are valid as indicated on the day of order. All goods offered in the salacca e-shop are non-binding and without engagement. Changes of prices are explicitly reserved.

Salacca does not reimburse VAT payments made by her customers.

4. Order/Completion of Contract

A contract between the customer and salacca becomes effective through the placing of an order by the client and its acceptance by salacca. An order is placed as soon as the articles in the shopping cart are transmitted and the order form provided by salacca in the internet is completed.

Salacca accepts the order by dispatch, i.e. by handing over the goods to the haulage contractor or post office.

Immediately after sending the order the customer will receive a confirmation of order dispatch via e-mail. This confirmation is an acknowledgement of receipt only and not an order acceptance.

The minimum order value is 10.00 EUR.

5. Right of Withdrawal with Return

The customer has the right to withdraw from the bill of sale within 2 weeks after receiving the goods, without explanation. To meet this deadline it is sufficient to send the note of withdrawal or the goods (including gift vouchers) in time. If the withdrawal concerns an order of 40.00 EUR or less the customer will have to carry the return freight charges. For this purpose the customer is obliged to stamp the parcel adequately.

If a customer, after using the right of withdrawal, is not able to return the goods or if the goods are damaged or have deteriorated, a legally admitted deduction will be made on the reimbursement price. The goods being returned have to be sent back as completely as possible and preferrably in original packaging, in any case in transport-safe packaging including sturdy outer boxes and including a copy of the delivery note. Any damages and delays caused by the non-fulfillment of these requirements are the customer's responsibility.
The right of withdrawal is excluded if the goods had been produced according to customer-specific wishes or the goods had unambiguously been shaped to meet customer-specific requirements or the nature of the goods does not allow them being returned or the goods could spoil quickly or the expiry date of the goods has been exceeded.

6. Guarantee

6.1. The customer is obliged to check the goods immediately after receipt. Obvious faults are to be reported to salacca in writing within 8 days. If this deadline is passed guarantee rights are excluded.

If the goods arrive damaged when delivered by the haulage contractor, the customer is obliged to write a note confirming the damage in the presence of the postman and inform salacca immediately: info@salacca.com.

Not obvious faults are to be reported to salacca immediately after detection, with the legal guarantee period of 24 months after delivery.

6.2. If the complaint has been justified, the customer can choose between having the goods repaired or exchanged. If the repair or exchange fails the customer has the right to demand a reduction of the sales price or cancellation of the contract. In the latter case the customer is obliged to return the goods.

7. Postage Fees

The postage fees are calculated by the e-shop system according to the weight of the goods ordered and the country of destination. For details please refer to "Shipping Terms".

8. Delivery

8.1. 8.2. Deliveries are made subject to correct and timely supplying of goods by salacca´s suppliers. If an article is sold out salacca is freed from the obligation to deliver. Salacca will inform her customers immediately about non-deliverable articles and reimburse any payments made.

Partial deliveries are legally defined as independent business transactions. If any article in a customer´s shopping cart cannot be delivered, a later delivery is excluded.

8.3. The customer is obliged to accept and receive the goods ordered. If the customer had completed a correct order but refuses to receive the delivery although there is no right of withdrawal according to chapter 5 of the general terms of business (see chapter 6 of GTB), salacca has the right to withdraw from the contract after a period of 14 days or to demand compensation due to non-fulfillment of the contract. The customer is liable for faulty delivery due to data which was incorrectly indicated or transmitted in written, oral or electronic form.

9. Payment

As a rule, first customers can opt for:

  • cash on delivery (with additional COD fees charged by the German Post)
  • PayPal
  • credit card payment (via Moneybookers)
  • prepayment (i.e. dispatch of goods only after receipt of full payment on salacca´s bank account).

With the second order customers are allowed to choose delivery upon invoice (payable within 14 days without deductions).

The purchase price is due for payment immediately, with each order.

If a customer who had placed an order upon invoice has delayed the payment or if there are justified reasons to doubt his/her ability to pay, salacca is free to execute any following orders via COD, according to the respective postage fees.

10. Default

If the term of payment has been exceeded salacca has the right to charge default interest amounting to 4% above the respective discount rate set by the German Bundesbank. If a customer who had placed an order upon invoice has delayed the payment or if there are justified reasons to doubt his/her ability to pay, salacca is free to execute any following orders via COD according to the respective postage fees.

11. Liablility and Restriction of Liability

Any claims for compensation against salacca are excluded irrespective of the legal reason, particularly the delay or impossibility of delivery, the violation of consulting or contractual obligations, pre-contractual duties, positive contract offences or unauthorised acts, if not salacca has acted on purpose or has been grossly negligent.

If salacca is liable, the claims for compensation are reduced to a predictable amount. In any case, the compensation for following damages, such as lost profit, is excluded. If and as far as the liability of salacca as selling agent is excluded, the same concerns apply to the personal liability of her employees, co-workers, representatives or auxiliaries. Salacca denies liablility for continuous and uninterrupted internet presence and for technical or electronic failures of the online offer.

12. Retention of Title

The goods ordered continue to be salacca´s property until full payment is made.

13. Data Protection

Personal related data which is necessary for the business procedure is saved in salacca´s accounting system and treated confidentially. Salacca does not transmit personally related data to third parties. The only exceptions are service partners (haulage contractors, couriers) who need the data to execute their business. Together with each order placement the customer explicitely accepts this data sharing through salacca. Each customer has the right to be informed and to correct, block or erase his/her saved data. For this purpose, a formless e-mail has to be addressed to: info@salacca.com.

14. General Rules

Salacca reserves the right to price changes, changes of goods to higher or lower amounts of grams/milliliters, identical products of other producers, deviations in format, colour, material and technical improvements, technical changes as well as error.

Each customer is obliged not to publish his personal salacca customer No., not to give it to any third party nor to make it available to any external person who is denied access.

Salacca reserves the right to change these Gerneral Terms of Business at any time and without indicating reasons. Such changes do not concern orderes being placed. With each order placement the respective actual TOB are accepted. These conditions of use are exclusively subject to German rights, excluding the UN Law of Sale.

15. Court of Jurisdiction

Court of jurisdiction and place of fulfilment of all disputes, arising from the contractural relation between the parties, is Munich provided the customer is a businessman, legal person of public law or public legal estate.

16. Severability Clause

In case any single item of these General Terms of Business are or become legally ineffective, the remaining parts will remain unaltered.
